Term and Conditions

These terms and conditions shall apply to all orders entered into by and between any distributor or any end-user of the Goods, whichever the case may be (“Buyer”) and ALPINE RIDING Inc. (“Seller”). These terms and conditions and any Seller quotation form submitted herewith or separately shall be collectively referred to hereinafter as the “Agreement.” Seller shall accept orders, sell Goods, and do business only upon these terms and conditions. Any additional or different terms in Buyer’s purchase order or other purchase documentation are deemed material alterations to this Agreement, and Seller hereby gives notice of its objection to them. The term “Goods” means all items sold and/or provided by Seller to Buyer.

Price

All prices are subject to change. Unless specified, prices also do not include any federal, state, or local taxes or other governmental charges upon or with respect to the sale, purchase, manufacture, delivery, storage, processing, use, or consumption of any of the Goods provided hereby. Prices are stated in U.S. dollars or, when indicated, in Canadian dollars. All major credit cards are accepted.

Specifications

Seller may, at its option, make changes in the designs, specifications or components of the Goods to improve the safety of such Goods, or if in Seller’s judgment, such changes will be beneficial to their operation, use, or image. ALPINE RIDING makes every effort to ensure that posted specifications, images, pricing and product availability are as correct and timely as possible. ALPINE RIDING reserves the right to make any and all changes deemed necessary in the course of business including but not limited to pricing, product specifications, quantities, and product availability.

Shipping and Delivery

ALPINE RIDING can ship to the United States and Canada. ALPINE RIDING will not provide information about customs and international fees. Buyer is responsible for researching additional charges for customs and international delivery. Buyer is subject to these additional duty charges. Title to and risk of loss for the Goods shall pass to Buyer upon delivery of the Goods by Seller to the common carrier for delivery. All time frames provided by Seller, whether verbally or in writing, are good faith estimates of the expected delivery date for the Goods. Seller shall use commercially reasonable efforts to fill Buyer’s orders within the time stated but in no event shall Seller be liable for any damages associated with Seller’s inability to meet any such time frames or deadlines, including but not limited to incidental or consequential damages arising therefrom. Should the buyer choose to opt out of the charge for Delivery Confirmation Signature, seller will not be held responsible for any lost, stolen, or damaged goods upon delivery.

Force Majeure

Seller shall not be responsible for any delay in the delivery of, or failure to deliver, Goods due to causes beyond Seller’s reasonable control including, without limitation, acts of God, acts of war or terrorism, enemy actions, hostilities, strikes, labor difficulties, embargoes, pandemics, non-delivery or late delivery of materials, parts and equipment or transportation delays not caused by the fault of Seller, delays caused by civil authorities, governmental regulations or orders, fire, lightening, natural disasters or any other cause beyond Seller’s reasonable control. In the event of any such delay, performance will be postponed by such length of time as may be reasonably necessary to compensate for the delay.

Assembly

If Buyer purchases any Goods that require assembly, Buyer shall, at its expense, make all arrangements and connections necessary to install and operate the Goods properly. Buyer shall assemble the Goods in accordance with any Seller instructions or recommendations and shall indemnify Seller against any and all damages, demands, suits, causes of action, claims and expenses (including actual attorneys' fees and costs) arising directly or indirectly out of Buyer's failure to properly install the Goods.

Use of Goods and safety

Buyer is responsible for using and maintaining the Goods properly and safely in accordance with any required laws and/or as set forth in manuals and instruction sheets furnished by Seller. Even if not compulsory, we highly recommend the Buyer to always wear a helmet and proper protective equipment. It is also the Buyer's responsibility to adjust the max speed according to local laws.

Warranty

ALPINE RIDING warrants that all new ALPINE RIDING products are warrantied to the Buyer against manufacturing defects in materials and/or workmanship for a period of (1) year from the date of delivery for electronic components including the battery and (3) years from the date of delivery for the frame. The warranty period is calculated from the point of delivery. The original receipt of purchase is required to establish proof of purchase and must be provided to ALPINE RIDING for all warranty claims. ALPINE RIDING will require the customer to complete a MANDATORY standard procedure for warranty claims that will involve media such as photos and videos to help ALPINE RIDING after sales staff establish the fault with the product.

Only the individual components themselves are covered by the warranty. The removal, assembly, and tuning requirements of the component is borne by the customer making the claim. The costs/inconvenience caused by the loss of use of the product, is not covered whilst the warranty procedure takes place. The warranty for replacement components will be based on the date of delivery. Under no circumstance will a replacement component have a warranty date different than the original date of delivery. If a replacement is necessary due to a defect in materials and/or workmanship, then upon return to ALPINE RIDING, the component will be replaced during the warranty period.

ALPINE RIDING will have no obligation under this limited warranty in the event the product is damaged or destroyed as a result of any of the following events: component use on a non ALPINE RIDING product, damage or destruction by abuse; collision; theft; improper maintenance or mishandling of the product; natural forces such as wind, lightning, hail, etc.; any willful or negligent act; penetration, or opening of the product casings in any manner. Replacement will be honored only by ALPINE RIDING.

This is ALPINE RIDING’s exclusive warranty. No party is granted express or implied authority to change or annul this warranty in any manner. Implied warranty including that of merchant-ability and fitness for a particular purpose are expressly limited in duration to the duration of this warranty. ALPINE RIDING disclaims any liability for special, incidental or consequential damages.

This warranty is not meant to suggest or imply that the products cannot be broken or will last forever. It does mean that the product is covered subject to the terms of the warranty. This warranty applies only to the original Buyer of the product and is not transferable to subsequent owners or any other party. This warranty is void if the product is subjected to abuse, neglect, improper repair, improper maintenance, alteration, modification, an accident or other abnormal, excessive, or improper use, at the sole discretion of ALPINE RIDING.

Warranty Exclusions

This warranty does not cover:

  • normal wear and tear
  • damage or failure from abuse, neglect, misuse, or accident
  • damage from stunt riding, ramp jumping, acrobatics, competitive events, such as bicycle racing, bicycle motocross racing, or similar activities or any activity that is not consistent with the intended use of the product
  • damages resulting from improper charging of the battery pack or use of any charger not supplied by ALPINE RIDING
  • The Battery, like all lithium-ion batteries, will experience gradual energy or power loss with time and use. Loss of Battery energy or power over time or due to or resulting from Battery usage, is not covered under Warranty.
  • installation of any parts, accessories, or electrical component(s) not originally intended for or compatible with the product as sold, or any modification of the frame or any component(s) originally supplied; tires, brake pads, chains, lights, motors, battery packs, displays, or vehicle controllers that have been opened for any purpose whatsoever, other than by ALPINE RIDING
  • All warranties are void if the product is used for any purpose other than the reasonable intended use of the product. Additionally, this warranty does not cover damage associated with commercial use.
  • Aftermarket components or modifications
    All implied warranties, including the warranties of merchantability and fitness for a particular purpose, are limited in duration to that of the express warranties stated above.
Warranty Procedure

Proof of purchase must be provided. To qualify for warranty services, a Warranty Product Return Authorization Number (“WPRAN”) must be obtained by the original purchaser from ALPINE RIDING. The original Purchaser must contact an ALPINE RIDING representative to discuss the problem with the product and to obtain a WPRAN. Upon issuance of a WPRAN, the product component(s) must be returned to ALPINE RIDING. The original Purchaser is responsible for the return of the product, undamaged in transit, to ALPINE RIDING for warranty work and for the costs associated with shipping the component(s) when returning them. If ALPINE RIDING determines a warranty claim is valid and conforms with this warranty, ALPINE RIDING will replace component(s).

Limited Remedy

Unless otherwise provided, the sole remedy under the above warranty, or any implied warranty, is limited to the replacement of defective parts at the sole discretion of ALPINE RIDING. In no event shall ALPINE RIDING be responsible for direct, incidental or consequential damages, including, without limitation, damages for personal injury, property damage, or economic losses, whether based on contract, warranty, negligence, product liability, or any other theory.

Modification

Buyer may request to modify an order before it has been shipped or within 10 days of purchase, whichever is sooner. After the modification period, Buyer is subject to a minimum $150 administration fee at manufacturer’s discretion. All modifications are subject to availability. There is no guarantee these modifications can be made unless approved by ALPINE RIDING. To file a modification claim, email info@alpineriding.com with your original order confirmation.

Cancellation

Due to the nature of our crowdfunding campaign and the fact that the funds from Indiegogo will be put directly into producing your A-Ride we do not accept any order cancellation beyond the scope of Indiegogo's policy.

Returns

Our extensive quality control means that our products are thoroughly tested and ultra-reliable by industry standards. All products are warrantied to work as described on arrival and for the warranty period. If there is a warranty claim, it will be assessed by ALPINE RIDING and new parts will be delivered upon claim’s approval. ALPINE RIDING will accept the return of warrantied components. If there is a major fault with the product, contact ALPINE RIDING immediately. ALPINE RIDING will not accept returns for change of mind. In the event a cancellation of your order is accepted by ALPINE RIDING, in its sole discretion, ALPINE RIDING reserves the right to charge an additional restocking fee equal to 40% of your purchase price plus additional shipping charges.

Payment Plan

During ALPINE RIDER’S 30-day campaign here on Indiegogo, you can select the perk to make a deposit, which will grant you a discount, as indicated, off the retail price. The remaining amount (perk final price + shipping – deposit) will be paid through a weekly payment over a period of 15 weeks or a monthly payment over a period of 3 to 6 months. After you make the deposit, we will send you a message within a couple of days and you will then have 10 days to start the payment plan. Our payment plans are set up by Partial.ly or Splitit. Please note that with monthly payments, as part of their security procedure, Splitit will check when you set up the plan that 60% of the remaining amount is available on your credit card but no amount will be held or charged other than the monthly payment.

By making your deposit, and accepting our terms and conditions for this purchase, you, the Buyer, commit to pay the full amount for the product you are purchasing. All payments you make, including the deposit, are NON-REFUNDABLE. For weekly payments, the product you are purchasing will not be shipped until paid in full. Any modification to the payment plan is subject to the approval of ALPINE RIDING, at its sole discretion, a $100 administrative fee and storage fees when applicable. In the event a cancellation of your order is accepted by ALPINE RIDING, in its sole discretion, ALPINE RIDING reserves the right to charge an additional restocking fee equal to 40% of your purchase price plus additional shipping charges, if applicable.

Privacy Policy

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by either opting out of our email list, emailing us, or mailing us the address at the end of this page.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
